Service CONDITIONS

General conditions

– For those services with an estimated duration of 9 hours or more, payment of a deposit in advance may be requested.

– In many cases, it will be necessary to purchase materials such as images, videos, templates or plugins, whose costs would be added to the invoice for the service provided. In the same way, for web design work, contracting external web hosting services and domains purchasing may be required, so these costs would be added to the total cost for the service hours provided.

– The hours used for sketching execution or animatics production or to carry out all the corrections that client deems necessary, will be billed ordinarily at the cost/h determined for the project. The time dedicated to carry out managements with other entities assigned to Xátiva – Producciones Gráficas & AV, such as printing management or registration in web services, will be billed in the same way.

– After completing the work, the final artwork will be delivered to the client with the resolution and in all the formats that have been stipulated in the project planning. Requesting the delivery of work in formats not previously foreseen, could lead to an extension of the necessary service time to attend this request, that would be billed at the cost/h determined for the project

– For extensive proyects with more than 135 service hours (3 full weeks), contact to obtain a better cost per hour.

– A 15% discount will be applied to new clients on the total cost of the service provided during the first month. This promotional measure is open to changes and may be modified without prior notice.

– Urgent orders that require attention and work overtime on weekends or holidays, may be carried out without prior notice by the client. These overtime hours may have a 50% surcharge on the cost/h determined for the project.

– The holiday period in Xátiva – Producciones Gráficas & AV, will be each year during August. In the event that the client requires the freelance service during the vacation period, it must be requested in advanced before July 15th. All service hours provided in August may have an additional 50% surcharge on the cost/h determined for the project.

Procedures

Budgets may be open, since in many cases it’s not possible to estimate with total precision the working hours that will be required to carry out the job and to contemplate the possible extension of the project’s scope while the service is offered, as well as for the accomplishment of all the corrections that client deems appropriate executing.

– It is recommended to study as precisely as possible the characteristics, contents and/or functionalities of each required piece, as well as consulting and agreeing with collaborators and partners, before transmitting all the information and requesting the start of the service. In this way, the amount of revisions and corrections necessary to obtain the final artworks will be lower. The clearer the client is about proyect needs before starting the job, the sooner the finished work will be delivered and a better price for the service received will be obtained.

– In case the proyect requires the delivery of contents (Texts, images, videos…) by the client, its production and compilation prior to contracting the service or the committed on time delivery of the those is recommended, so workflow won’t be interrupted and the availability of the final artworks at the agreed time will be possible.

– During the project planning, deadline dates for the delivery of final artworks will be agreed with the client. Depending on that delivery date, a series of work sessions will be established that will be consecutive and longer for urgent jobs or that can follow the pace set by the client and have a shorter duration. Each work session will have a duration of 1 hour minimum and 12 hours maximum.

– Fluid communication will be established with the client and the work progress will be reported after each work session, presenting updated samples and informating about the number of hours invested in that session. The client can request video conferences at any time for work planning, efficiently clarifying any matter related to the order.

– Time invested in each work session will be calculated using specialized software: TimeEdition

– The invoice will be sent to the client for the carried out work upon completion and delivery of final artsworks. For more than one month duration services, a partial invoice may be sent for presented work, at the end of that month; It will be previously agreed with the client how to make payments in these cases.

Confidentiality

Xátiva is firmly committed to clients in the use of the provided data, solely and exclusively to carry out the requested work. No contents or sensitive information will be distributed by any means and under no circumstances to third parties. If the client considers that the delivered data and contents, requires high security in this regard, a confidentiality contract will be signed and sent to formalize the commitment.

Intellectual Property Rights

Pablo Játiva López is the owner of all the copyright and intellectual property rights for www.xativasite.com contents.
The total or partial reproduction, publication and/or not strictly private use of this site’s contents, is not allowed without prior and written consent.
The use of the services and products provided by Xátiva – Graphic & AV Productions, contrary to the intellectual property legislation is forbidden, in particular of:
• The use that is contrary to internayional laws or that infringes the rights of third parties.
• The use of the domain’s mail server and email addresses to send mass spam.

The ownership of the final artworks and their commercial exploitation correspond exclusively to Xátiva’s clients. Low resolution samples (72ppp) of final pieces resulting from the service provided may be included in www.xativasite.com.

Privacy POLICY

Commercial communications

In application of the LSSI, Xátiva – Producciones gráficas y AV will never send persistent advertising or promotional communications by email or other equivalent electronic communication tools. When using www.xativasite.com contact forms, the email of the interested user may be included in a select database for eventual sending of newsletters, with an approximate periodicity of 2 months. In the case of users with whom there is a prior employment relationship, Xátiva – Graphic Productions and AV is authorized to send commercial communications regarding the services of Xátiva – Graphic Productions and AV that are similar to those initially contracted with the client.
In any case, after proving his identity, the user may request that no more commercial information can be sent to him through the email info@xativasite.com or by using a specific button included in the promotional communications themselves, which will automatically end the sending of any communication from Xátiva to the receiving email address.

Data retention in accordance with the LSSI

Xátiva – Graphic & AV Productions informs that, as a data hosting service provider and by virtue of the provisions of Law 34/2002 of July 11 on Services of the Information Society and Electronic Commerce (LSSI), retains for a maximum period of 12 months the essential information to identify the origin of the data stored and the moment in which the provision of the service began. This data retention does not affect the secrecy of communications and may only be used in the framework of a criminal investigation or to safeguard public safety, making it available to judges and/or courts or the Ministry that so requires.
The communication of data to the State Authority Forces will be done in accordance with the provisions of the regulations on protection of personal data.

Protection of personal data according to the GDPR

In application of current regulations on personal data protection, personal data collected through the forms of the website www.xativasite.com, are only included in the specific automated users files of the specified graphic production services.
The collection and automated processing of personal data is only intended to maintain the business relationship and the performance of information tasks, advice and other activities of Xátiva – Graphic & AV Productions.
These data will only be transferred to those entities that are necessary for the sole purpose of complying with the aforementioned purpose.
Xátiva – Graphic & AV Productions adopts the necessary measures to guarantee the security, integrity and confidentiality of the data in accordance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council, of April 27, 2016, regarding the protection of natural persons with regard to the processing of personal data and the free circulation thereof.

Which is the purpose of processing your personal data? At Xátiva – Graphic & AV Productions, we will treat your personal data collected through Xativasite’s contact forms, with the following purposes:
1. In case of contracting the services offered through www.xativasite.com, to maintain the contractual relationship, as well as for the management, administration, information, provision and improvement of the service.
2. Sending requested information through the forms provided at www.xativasite.com
3. Send newsletters, as well as commercial communications of promotions and/or advertising of Xátiva – Graphic & AV Productions.
We remind you that you can oppose the sending of commercial communications by any means and at any time, by sending an email to the email address info@xativasite.com. Newsletters will always include a link to reject the reception of any more of this type of information.
It is necessary to complete all the fields in Xativasite’s contact forms, making it possible to carry out the expressed purposes. The data will not be communicated to any third party outside Xátiva – Graphic & AV Productions, except legal obligation.
For how long are the personal data collected kept? The personal data provided will be kept as long as the commercial relationship is maintained, data may be deleted by request and during the period for which legal responsibilities could arise for the services provided.

Legitimation

The processing of your data is carried out with the following legal bases that legitimize it:
